The purchase of services from REACTION RETAIL S.a.s. involves the acceptance of the following terms and conditions:
Reservation:
The reservation is considered completed only when the customer receives a confirmation of acceptance from REACTION RETAIL S.a.s. This confirmation will be automatically sent immediately after the completion of the booking procedure on the website. In the case of reservations made via email, REACTION RETAIL S.a.s. will confirm the reservation using the same means. If the customer does not receive an acceptance confirmation for the purchased service, it is their responsibility to contact REACTION RETAIL S.a.s., which will then resend the necessary information. If the customer does not notify REACTION RETAIL S.a.s. of the non-receipt of the confirmation message, they may lose the opportunity to use the service. In such a case, REACTION RETAIL S.a.s. assumes no responsibility and will not issue any refunds. REACTION RETAIL S.a.s. commits to ensuring the completeness and accuracy of the information provided; however, it is the customer’s responsibility to carefully read and verify the details in the confirmation email. Any corrections or the need to resend the confirmation email must be communicated to REACTION RETAIL S.a.s. in a timely manner. If this does not happen, the customer may lose the opportunity to use the service. In this case, REACTION RETAIL S.a.s. assumes no responsibility and will not issue any refunds. The price of the tour is the one indicated on the Sorrento Bike website. At the time of booking the service, REACTION RETAIL S.a.s. requests the full amount, 100% of the price of the requested service. The reservation will be considered finalized when the total payment for the requested service is made. Requests for payment extensions or partial payments will not be accepted.
Prices:
The price of the tour or rental is the one indicated on the website or, in the case of direct purchase of the service at the rental location, the price shown in the price list available there.
Delivery and Payment for services purchased at the rental location or the tour departure point:
The customer will pay for the service before the start of the tour or rental, and payment may be made in cash or by credit/debit card. At the time of departure, it is necessary to present a valid identity document, which the service provider will photocopy and retain until the end of the service, solely for legal purposes.
For rental only, a security deposit of €200 will be held for each e-bike/MTB/racing bike rented. This deposit may be paid in cash or by credit card (with a freeze, no transaction) and will be returned upon the bike’s return after a concurrent inspection of the condition of the vehicle(s). At the time of delivery of the vehicle(s), a handover and return report will be filled out. The customer must complete and sign the contract form provided beforehand. The renter and the person renting will check the functionality of the vehicle and its accessories. By taking possession of the bicycle and accessories, the renter acknowledges the vehicle is mechanically sound by signing the handover report. Before departure, the customer may take a short test ride around the rental point, and if they detect any mechanical issues with the bike or discrepancies in the accessories, they must notify the renter promptly and request a replacement or repair if possible. The renter, having taken possession of the bike and accessories in good working condition, agrees to return them in the same condition (allowing for normal wear) to the TECNOBIKE SORRENTO S.r.l. location or, by agreement with the renter, another location. The customer agrees to return the bike and accessories within the time limits stated in the rental contract. In case of malfunction, the customer may exchange their vehicle for another functioning one by contacting the renter promptly and explaining the reasons for the damage to the bike as well as the specific damages. The replacement of the bike or accessories will be subject to availability at the time of the breakdown and may be done with a model of the same or different technical specifications at the discretion of the renter. Upon returning the bike and/or accessories, the renter will complete and sign the handover report, verifying the integrity of the vehicle or any damage to the borrowed and returned items. In the case of damage or breakage caused to the rented vehicle or accessories not attributable to normal use, the user must pay TECNOBIKE SORRENTO S.r.l. for the damages, which will be quantified by their staff upon return of the vehicle. The user is responsible for damages caused during the use of the vehicle to themselves, third parties, property, as well as the bike and accessories. Repair costs are listed in the repair price list available at the facility. On-site assistance will be provided based on the location of the vehicle and the complexity of the malfunction, so immediate intervention cannot be guaranteed. The costs for on-site assistance are available in the repair price list at the facility.
If the customer refuses to sign the handover and return report or disagrees with the renter’s claims, the renter has the right to act in accordance with these General Conditions, especially those related to payment of compensation and the security deposit.
Bike Tour Cancellation Policy:
In case of cancellation, the following penalty applies:
• Up to 3 days before the service: 6% of the ticket price
• 2 days before: 50% of the ticket price
• 1 day before: 100% of the ticket price
• No-show: 100% of the ticket price
Any insurance taken out by the renter, included in the fee, will cease to be effective upon the expiration of the contract unless the contract is modified (extension of the rental period) by mutual agreement.
Bicycle Rental Cancellation Policy:
The cancellation or early extension of this contract must be requested by the customer with at least 24 hours’ notice. Failure to comply with this clause in the event of cancellation will entitle the renter to charge the full amount as per the contract; in the case of a contract extension request, failure to comply with this clause will entitle the lessor to reject the request; in case of delay, an additional charge of 50% of the contracted amount will apply. Any insurance taken out by the renter, included in the fee, will cease to be effective at the expiration of the contract, unless it is modified (extension of the rental period) by mutual agreement.
Delay and No-show:
Participants must be at the agreed meeting point 15 minutes before the scheduled departure or pick-up time. If they are not present at the agreed time or within the next 15 minutes, the case will be considered a "No-show," and no refund will be issued. REACTION RETAIL S.a.s. will automatically consider the tour or rental cancelled, and the customers will not have the right to any alternative timing options. They will need to repurchase the service at full price, following the usual contractual terms.
Force Majeure:
REACTION RETAIL S.a.s. reserves the right to cancel the tour in the event of adverse weather conditions and/or force majeure causes that may compromise the safety of participants. In this case, customers may reschedule the tour for another date, depending on their availability and that of REACTION RETAIL S.a.s.; if this is not possible, REACTION RETAIL S.a.s. reserves the right to offer substitute services that, at the company’s discretion, will be considered of equivalent value to the originally booked service. If the substitute service is unavailable or the customer does not accept it, REACTION RETAIL S.a.s. will issue a refund for the full amount paid by the customer. A full refund is also provided if the service cannot be provided due to events such as natural disasters and/or unpredictable weather, public authority decisions, acts of war and/or terrorism, disturbances, protests, strikes, disasters, accidents, theft, health emergencies, and similar events.
Interruption:
The early interruption of the tour or rental by a participant will not entitle them to any refund.
Risks and Responsibilities:
The services offered by REACTION RETAIL S.a.s. are not comparable to a tourist package. Our tours or recommended rental routes have various levels of difficulty, with the associated risks inherent in practicing the activity; in this regard, each participant declares they have received all necessary information and accepts personal responsibility for the risks arising from the activity, affirming they know how to ride a bike and are in good health. They agree not to hold REACTION RETAIL S.a.s., the guides, or other service providers responsible for any events or accidents that may occur during the normal course of the activities. This clause also applies to all rights holders and family members. The use of the bike is reserved for adults, unless the minor is accompanied by a parent or guardian who assumes full responsibility for any damage caused to third parties by the minor or suffered by the minor themselves. Every participant must adhere to prudence rules and the current provisions of the Highway Code and follow the advice provided by any accompanying guides. In no case can REACTION RETAIL S.a.s. be held responsible for accidents caused by imprudence and/or negligence of a group member. The customer is required to pay any fines resulting from violations of road rules committed by them. REACTION RETAIL S.a.s. reserves the right, in case of particular circumstances that may jeopardize the safety of the group, to modify the itinerary or some of the services included in the program, either directly or through the guide. On self-guided rentals, there are recommended routes without the presence of a guide. These self-guided tours require appropriate map-reading skills and orientation abilities. REACTION RETAIL S.a.s. cannot be held responsible for accidents resulting from imprudence and/or negligence by a participant. Consequently, each participant agrees to accept these risks and not to hold REACTION RETAIL S.a.s. or other service providers responsible for any events or accidents that may occur. This clause also applies to all rights holders and family members. Participants in a tour or renters will be held responsible for damage to the equipment provided by REACTION RETAIL S.a.s. and TECNOBIKE SORRENTO S.r.l. and are required to pay the corresponding compensation in cash or by credit card. The failure to return the bike (or accessories) within 24 hours of the agreed return time will be considered theft or misappropriation and will be pursued accordingly. The renter has the right to inform the police and other competent authorities.
Theft:
In case of theft of the rented bike or accessories, the customer must provide TECNOBIKE SORRENTO S.r.l. with a copy of the theft report filed with the relevant judicial authorities and, within three days from the date of theft, deposit a sum equal to the list price of the bike and the other stolen items, taking into account the wear of the bike and accessories until the moment they were handed over. The amount paid by the renter will only be refunded if the bike and/or accessories are recovered and the condition is evaluated against their state at the time of the rental. Otherwise, the amount will be retained as compensation for the damage. If the bike and other items are recovered and returned to TECNOBIKE SORRENTO S.r.l., the company will refund the deposit to the customer; otherwise,TECNOBIKE SORRENTO S.r.l. will retain the amount as compensation for the damage.
Insurance:
We strongly recommend that you obtain travel insurance to cover cancellations due to unforeseen circumstances or events beyond our control. We also recommend medical and personal insurance to cover medical expenses and the loss of luggage or personal belongings.
Disputes:
The contract is governed by Italian law, and in the case of disputes that cannot be resolved amicably, the exclusive jurisdiction is assigned to the Italian court. For any dispute arising from the interpretation or execution of the signed contract that cannot be resolved amicably, the exclusive jurisdiction is the Court of Torre Annunziata, excluding any other court, even alternative or concurrent. For matters not expressly covered in this document, reference is made to the Italian Civil Code.
